Violence Over A Parking Space

I will never understand how someone can commit horrific violence of rage against others, and due to that lack of understanding, I see negatives when reading of it. On February 25, 2011, in New York, Lana Rosas decided to stand in a parking space and wait for her boyfriend to arrive so (according to reports in news) they could dine out. She wanted to save the parking spot for him.


Oscar Fuller wanted to park his car in the spot Lana was standing in so he could (according to reports in news) attend a birthday party. According to his account he ‘politely’ asked Lana to step aside so he could park and she refused. Mr. Fuller then exited his vehicle and she began punching him in the eye and face. Fuller claims self defense and reflex action for hitting Lana so hard it pulled her off the ground and caused her to drop to the concrete. Mr. Fuller fled the scene but Lana’s boyfriend saw the altercation and rushed to Lana’s defense. He also got the tag number of the car Fuller was driving.

Paramedics rushed an unconscious Lana to the hospital; she is still in a coma and fighting for her life. Doctors have removed part of her skull due to brain swelling. As they were treating Lana at the scene and later rushing her to the hospital, Mr. Fuller calmly went to that birthday party.

Fuller says he regrets hitting her and wishes it’d never happened. He blames his reflex actions on his teen years when he was attacked and cut on the face. The scars of that cut are still visible on his face today. However, it seems Mr. Fuller has a history of committing assault and drug possession.  Fuller is a big man, 5-feet-7 weighing at least 150 pounds. Lana weighs 100 pounds and is 4-foot-11.

I do not know if the altercation was caught on a camera or if Lana’s boyfriend or some other bystander just witnessed it, but ‘no excuse’ is a good excuse for doing what he did. So far as I know, we only have his word that Lana attacked him first. He claims he is a man of God and does not hit women. I ask, if she did throw the first punch, why did she? Did Fuller threaten her and that was why he exited his car, to carry out that threat? I personally see no reason he should have left his car if he did not intend to harm her in some way.

I am a bit upset that while Lana lies in a hospital bed fighting for her life, Oscar Fuller is out on bail living his.

  3. What really gets me Anonymous is that when he was indicted by grand jury for felony assault his lawyer contended it should be a misdemeanor and not a felony.

    Fuller will be back in court on April 7 to enter his plea. According to his lawyer, that plea with be NG.. Fuller's lawyer says lack of intent and forseability of the injuries exists.

    I personally believe it was rage and deliberate intent to harm. He ran! That to me also shows a knowledge of his actions being brutal and an attempt to escape punishment.

  5. Mr. Fuller is headed to trial on Oct 24 2011.
    I hope Lana gets justice. She was hit so hard it picked her up off the ground and she fell to the concreted ground, caused facial injuries and shook her brain so hard she was in a coma for several days.

  7. I agree with you Ajlounyinjurylaw. I don't think he had a reason to hit her as he did. And think it shows just how violent he can be and makes him a danger to society.

    I love that the judge is allowing pics of him to be seen by jurors. Now if he will allow the 911 call to be heard it will help.

    Justice for Lana is priority.

  9. According to what's being said via witness testimony in the trial Oscar Fuller's statements to police after the attack on Lana was not what they saw and heard. Witness testimony is countering his video taped statements. From what witnesses are saying, he wasn't Mr. Calm and just 'tapped' her. Jurors heard how he pulled his car up and braked within inches of her. Fuller, according to witnesses, was in her face with his screams and in an aggresive, violent rage. Allegedly he leaned back and with all his weight flew into Lana. To describe the incident one said the hit made a huge sound, 'the whole street gasped'.

  10. The state rested it's case yetserday. Lana Rosas mom told the jurors her daughter has memory loss and doesn't remember the attack. Lana did not testify. (her boyfriend had previously said that also. He also said she has mood swings) Lana's forrehead had to be removed due to the swelling of her brain and still hasn't been replaced. She wears a helmet to protect her brain and was in court. Doctors placed her forehead in her abdomen until it can be replaced at some point.

    Fuller's lawyer called a couple witnesses including a woman who was in the car with Fuller at the time of the attack. She claims as Fuller does it was reflex from her attacking him. But all the eyewitnesses state called disputes that.

    I have to wonder why the woman with Fuller wasn't charged as well with accessory or something. Fuller fled and allegedly said he intended turning himself in after his birthday.

  11. Sadly the juror did not reach a verdict Friday so they'll be back Monday. I hope they come back guilty as charged too. To me, from what was given as evidence in court, he deliberately put all his weight into the punch with full intent to harm. Lana will never be the same.

  14. Tyler I agree with your opinion. Sadly the jurors couldn't reach a decision. They had conflict over 'intent' and allegedly asked for a read back of instructions on it a few times. What about intent could someone not get... witnesses testified that he was in a rage, screaming at her and in her face. He raised back his arm with fist clinched and hit her full force so hard it picked her up off the ground and caused her to hit the street. It caused brain swelling. When he hit her that hard, he had intent to harm to me. It wasn't a tap as he said. He meant to cause her harm. He was angry because she defied him. He allegedly has a history of assault. And the coward ran!

    The judge finally called a mistrial but prosecutors aren't letting it go. On Jan 5 they will be back in court to start the process of setting a new trial. Hurray for Prosecutors! Fuller should be in jail in my opinion and Lana deserves justice. Her injuries were so bad she has no memory of the attack and couldn't testify. She has to wear a helmet because her brain hasn't healed enough to replace her skull. I hope her family has a civil suit in the works already.

  15. Fullers new trial is set for March 8. I hope the new jury can understand intent and reaches the appropriate verdict.
